You also agree and understand that we do not endorse, advertise, or promote any of the listings, postings, or information, nor do we come into possession of or engage in the distribution of any of the items and/or services about which you have posted, listed, or provided information on our site. While interacting with other users on our site, we strongly encourage you to exercise reasonable diligence and use judgement and common sense before committing to or completing any intended sale, purchase of any goods or services, or exchange of information, just as you would in traditional off-line channels.

When using myshahar classifieds and other services such as discussion forums, comments and feedback, and other services, you agree to post in the appropriate category or area, and that your use of the Site will be strictly governed by this AUP, including the policy for listing your Classified, which shall not violate the prohibited and restricted items policy (herein after referred to as the Listing Policy.) By reference, the following listing policy is incorporated into this AUP and should be considered as part of it:

• "Any information" "Your Information" refers to the information you provide to us or other users of the Site during the classifieds registration, posting, listing, or answering process, in the feedback area (if any), through the discussion forums, or when using any other aspect of the Services. You accept that you are the rightful owner of your information, with all rights, title, and interest in it, and that you are solely responsible and liable for it, and that we are merely a platform for you to distribute and publish it online.
• You agree that the following purposes will be served by your listing, publication, and/or information:
  1. shall not be deceptive or misleading, nor shall it refer to the sale of illegal, counterfeit, or stolen goods or services.
  2. shall not apply to goods or services for which you are not the legitimate owner, for which you do not have the right to 'list,' or for which you do not have the authorization to 'list.'
  3. Should not belong to someone else or to which the user has no legal claim;
  4. Defamatory, obscene, pornographic, pedophilic, invading another's privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to current laws are prohibited.
  5. It must not be dangerous to children.
  6. There shall be no infringement of any patent, trademark, copyright, or other proprietary rights;
  7. Shall not infringe any laws that are now in force;
  8. Shall not deceive or mislead the addressee as to the origin of the message, or intentionally and purposefully divulge any material that is plainly incorrect or misleading in character but might be reasonably regarded as a fact;
  9. Shall not act as if he or she is someone else;
  10. Shall not jeopardise India's unity, integrity, defence, security, or sovereignty, friendly relations with foreign states, or public order, or incite someone to commit a crime, obstruct an inquiry, or disrespect another country;
  11. Shall not include any software virus or other computer code, file, or programme designed to disrupt, destroy, or limit the functionality of any computer resource;
  12. Shall not be flagrantly false and untrue, and written or published in any form with the intent to deceive, harass, or harm a person, entity, or agency for financial benefit.
  13. Shall not be considered a deceptive trade activity.
  14. Spam, multiple / chain letters, or pyramid schemes, in any form, shall not be distributed or contained.
  15. shall not disseminate viruses or other technologies that may harm myShahar or myShahar users' interests or property, or place an unreasonable load on the infrastructure, or interfere with myShahar's normal functioning.
  16. shall not, directly or indirectly, offer, seek to offer, trade, or attempt to trade in any goods or services that are forbidden or restricted in any way under the provisions of any current or future applicable law, rule, regulation, or guideline.
  17. shall not be posted in an erroneous category or section of the site.
  18. shall not be posted on any other myShahar site other than the one dedicated to the city in which you reside.
  19. shall not list, post, or refer to any information that is forbidden or restricted under Indian law, and such listing, posting, or information shall not violate myShahar's.
  20. You agree to receive notifications relevant to the services provided through the website via email, phone, or any other electronic or other method of contact.
• You agree that your listing, posting and / or Information:You are responsible for maintaining the confidentiality of your User ID, password, and email address, as well as restricting access to your computer, computer system, computer network, and myShahar account, if you use the Site by registering on the Site, and you are responsible for all activities that occur under your User ID and password. If you access the Site by any electronic device other than through registration on the Site, the AUP still applies to you as if you were a registered user.

The Sellers represent and warrant to myShahar that all content relative to the goods/services that have been listed is correct. Any kind of advertisement. Posting must be consistent with the items and services' actual features, access, and usage conditions.

Use of www.myshahar.com,either by registration or by any other means, is available only to persons, who are Citizens of the Republic of India, who are 18 yrs of age and above and persons who can enter into a legally binding contract, and or are not barred by any law for the time being in force. If you access myShahar, either by registration on the Site or by any other means, not as an individual but on behalf of a legal entity, you represent that you are fully authorized to do so and the listing, posting or information placed on the site on behalf of the legal entity is your responsibility and you agree to be accountable for the same to other users of the Site.

You agree to inform us if you come across any listing or posting that is offensive or violates our listing policy or infringes any intellectual property rights by clicking on the following link support@myShahar.com to enable us to keep the site working efficiently and in a safe manner. We reserve the right to take down any posting, listing or information and or limit or terminate our services and further take all reasonable technical and legal steps to prevent the misuse of the Site in keeping with the letter and spirit of this AUP and the listing policy. We have also appointed an Grievance Officer whose details are in the last portion of these Terms.

You agree that if your listing, posting, or information violates any provision of this AUP or the listing policy, we reserve the right to remove the offending content, terminate or suspend your membership in the Site, and refuse to give access to you or anyone acting on your behalf.

If any of the content you've uploaded is disabled or removed, we'll send you an email explaining why. You will be provided a reasonable and appropriate opportunity to contest the action taken and to request that access to the removed content be restored. This process will be overseen by the Resident Grievance Officer (details in the sections below).

We will not host, store, or publish any unlawful information that is prohibited under any law currently in force in relation to the sovereignty and integrity of India, security of the State, friendly relations with foreign states, public order, decency, or morality, or in relation to contempt of court, unless we receive actual knowledge in the form of an order by a court of competent jurisdiction or upon notification by the appropriate government or its agency.

If we are hosting any such information, we will remove or disable access to it no later than 36 hours after receiving the court order or being alerted by the appropriate government or its agency.

We will also transmit any information in our control or custody to the appropriate government agency within 72 hours for the purpose of verifying identity or the prevention, detection, investigation, or prosecution of offences under any current legislation, or for cyber security events.

We will respond within twenty-four hours of receiving a complaint from an individual or any person acting on his or her behalf, in relation to any content that is prima facie in the nature of any material that exposes an individual's private area, shows such individual in full or partial nudity, or shows or depicts such individual in any sexual act or conduct, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual.

The Site contains content which includes Your Information, myShahar's information and information from other users. You agree not to copy, modify, or distribute such content (other than Your Information), myShahar's copyrights or trademarks. When you give us any content as part of Your Information, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right and license to use, reproduce, publish, translate, distribute, perform and display such content (in whole or part) worldwide through the Site as well as on any of our affiliates or partners websites, publications and mobile platform. We need these rights with respect to the content in Your Information in order to host and display your content. We reserve the right to delete any such content if we have reasonable reasons to believe it violates these terms, our Listing Policy, or the rights or laws of any third party.

You agree not to hold www.myShahar.com or any of its officers, employees, agents responsible or accountable for any of your or other user's listing, postings or information and nor shall we, our officers, employees or agents be liable for any misuse, illegal activity or third party content as postings, listings or information are generated by various users directly and we do not have any role in the creation, publication or distribution of the posting, listing or information, nor are we in a position to have editorial control over the substance or content contained in the listings, postings, or information, save and except to the extent provided in these terms.

You acknowledge and accept that we are not responsible for the authenticity or legitimacy of any listing, posting, or information provided by other users. You further agree that we are not responsible for any loss of money, goodwill, or reputation, as well as any special, indirect, or consequential damages, resulting from your use of the site or any sale, purchase, or exchange of products and services with other site users. We also cannot guarantee that our Services will be available at all times or that they will be secure. As a result, we disclaim all implied warranties of merchantability, fitness, or quality of the Site and our services to the extent permissible by law.

By using myShahar, you agree to the collection, transfer, storage and use of any personal information provided by you on the Site by myShahar LLP. The data is stored and controlled on servers located in North am, India as further described in our Privacy Policy. By submitting your resume with your replies, you give permission to myShahar to publicly display your resume which can be freely accessed by anyone. You also agree to receive marketing communications from us unless you specifically indicate otherwise in writing to us through support@myShahar.com. You agree that myShahar may use the information you supply to offer customer service and to determine whether any other services or advertisements on the myShahar website might be of interest to you.

You agree that we may share personally identifiable information about any individual with our agents, recruiters, or Affiliates, which are defined as anyone who controls, is controlled by, or is under direct or indirect common control with myShahar, including its subsidiaries and associate companies, directly or indirectly.

You acknowledge that, upon receiving a written request from a person who has purchased goods or services, myShahar may be required by law to divulge information about the Seller, including:

• Address of headquarters and all branches
• Name and details of sellers website
• E-mail address of Seller
• Other information necessary for communication with the Seller

We reserve the right to change this AUP or the listing policy at any time and to notify you of such changes by a message on the message boards and/or email communications. The new AUP and/or Listing Policy will go into effect right away. We may disclose personal information with another company if we or our corporate affiliates are involved in a merger or acquisition, but this AUP will still apply.

Once a year, you will also receive an e-mail informing you of any changes to these Terms.

You agree to receive an email at least once a year informing you that if you do not comply with the Information Technology (Intermediaries Guidelines) Rules, 2011, these terms, policies, or both, we reserve the right to immediately terminate users' access or usage rights or remove non-compliant information.

myShahar may give connections to other entities' websites on its website. If a user chooses to browse this site, they do so at their own risk and are subject to the terms and conditions of use and privacy policy of that site, which may differ from those of this site. It is the users' obligation to take all necessary precautions to avoid becoming infected with viruses or other harmful components while visiting these sites. myShahar makes no warranty or representation about any linked website, the information contained therein, or any of the products or services listed thereon, and does not endorse any of the products or services described thereon.

Furthermore, all interactions between users and organisations and/or individuals found on or through the service, including payment and delivery of goods and services, as well as any other terms, conditions, warranties, or representations associated with such dealings, are solely between the user and such organisation and/or individual. Before engaging in any offline or online transaction with any of these third parties, the user should conduct any research they deem necessary or suitable.

The laws of the Republic of India shall govern and construe this AUP and the Listing Policy, and the courts of Dehradun shall have exclusive jurisdiction over all matters and disputes arising out of or pertaining to the Site.
